2.1 What the Facilitator is

Nivesh Suvidha is designed to help investors find information about processes, investment policies, incentive schemes, industrial land, approvals, and related services offered by the Government of Uttar Pradesh. It is built and operated by an authorised service provider on behalf of Invest UP.

2.2 What the Facilitator is not

The Facilitator is AI-powered and is not a government official, legal adviser, or authorised decision-maker of Invest UP or the Government of Uttar Pradesh. Use of the Facilitator does not constitute a formal government interaction. The Facilitator:

• cannot make binding decisions on eligibility, approvals, or entitlements;
• cannot guarantee the accuracy, completeness, or currency of any information it provides;
• does not provide legal advice; and
• is not a substitute for professional legal, financial, or regulatory advice.

2.3 Information only

All responses are for general information purposes only. Nothing provided by the Facilitator constitutes a government order, an administrative decision, a representation, or a warranty of any kind. You must independently verify all information before relying on it or taking any action.

3.1 Sources relied upon

The Facilitator generates responses using a combination of publicly available documents and data including materials published by Invest UP, Nivesh Mitra, and Nivesh Sarathi; and curated datasets sourced from third-party data providers, which may include proprietary or non-public data.

3.2 Currency of information

Government policies, incentive schemes, and approval processes change over time. The Facilitator's responses are generated based on documents available at the time of its most recent update and may not reflect the most recent government orders or policy amendments. Always verify through official Invest UP channels and relevant government notifications before making any decision.

3.3 Calculations and assumptions

Where the Facilitator provides incentive calculations or eligibility assessments, these are based on the inputs you provide and the parameters in the source policies at the time of the last update. The Facilitator will state the assumptions it is relying on. These calculations are indicative only and do not constitute a formal determination of entitlement.

3.4 Google Maps attribution

Nearby amenity and facility information is sourced from Google Maps and is subject to Google's own terms and accuracy standards. Invest UP does not warrant the accuracy or completeness of location data derived from this source.

4.1 Permitted use

You may use the Facilitator solely for the purpose of obtaining information about investment facilitation in Uttar Pradesh.

4.2 Prohibited conduct

You must not:

• use the Facilitator to generate or act on information for any unlawful purpose;
• attempt to manipulate or adversarially exploit the Facilitator's AI system or moderation mechanisms;
• attempt to extract, reverse engineer, or replicate the Facilitator's underlying system; or
• use automated means to query the Facilitator at scale without prior written permission from Invest UP.

4.3 Consequences of misuse

Invest UP reserves the right to restrict or terminate access to the Facilitator for anyone who breaches these Terms without prior notice.

5.1 Government content

The source documents, policies, schemes, and data used by the Facilitator are published by the Government of Uttar Pradesh and are subject to applicable government copyright and open data policies. Nothing in these Terms grants you any ownership over government publications or data.

5.2 The Facilitator platform

The Nivesh Suvidha platform, including its interface, and architecture, is owned by Invest UP. You may not copy, reproduce, distribute, or create derivative works based on the Facilitator or its outputs for commercial purposes without prior written permission from Invest UP.

5.3 Your inputs

You retain ownership of the queries and content you submit. By submitting content, you grant Invest UP a non-exclusive, royalty-free licence to process that content for the purpose of generating a response and, subject to the Privacy Notice. Your query content is not used to train or improve the underlying AI models. Where you choose to provide feedback through the Facilitator, Invest UP may review and use that feedback to improve the Facilitator, as described in the Privacy Notice.

5.4 AI-generated outputs

Responses generated by the Facilitator are intended to help users understand publicly available government information. They should not be presented as official government communication.

6.1 No warranty of accuracy

The Facilitator is provided on an as-is and as-available basis. Invest UP makes no warranty, express or implied, that the information provided is accurate, complete, current, or fit for any particular purpose.

6.2 AI limitations

The Facilitator is an AI system and may on occasion produce responses that are incomplete, factually incorrect, inconsistent, or based on outdated information. Invest UP does not warrant that the Facilitator will operate without error or interruption.

6.3 Consistency

AI systems may generate varying responses to similar queries. While Invest UP takes reasonable steps to ensure consistent application of policies, it does not warrant that responses will be identical across all sessions. If you believe you have received an inconsistent or incorrect response, please use the Report an Issue function.

6.4 Availability

Invest UP does not warrant that the Facilitator will be available at all times. Access may be interrupted for maintenance, updates, or reasons outside Invest UP's control.

7.1 User's responsibility to verify

You are solely responsible for verifying any information provided by the Facilitator through official Government of Uttar Pradesh channels before making any decision or taking any action.

7.2 Exclusion of liability

To the fullest extent permitted by applicable law, Invest UP shall not be liable for any loss, damage, cost, or expense, whether direct, indirect, or consequential, arising from:

• your reliance on any response generated by the Facilitator;
• any inaccuracy, omission, or outdated information in the Facilitator's responses;
• any decision or action taken on the basis of the Facilitator's outputs; or
• any interruption or error in the operation of the Facilitator;
• or any other loss or cost connected to your use of the Facilitator, even if it isn't specifically listed above.

7.3 Statutory rights

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable Indian law, including liability for breach of any statutory duty imposed on a government body.

8.1 Google Maps

Nearby amenity data is sourced from Google Maps. Your use of this information is also subject to Google's Terms of Service. Invest UP is not responsible for the accuracy or availability of Google Maps data.

8.2 External links and portals

The Facilitator may reference official government portals and external resources. Invest UP is not responsible for the content, availability, or accuracy of any third-party website or service.

10.1 Raising a concern

If you believe the Facilitator has provided incorrect, incomplete, or misleading information, or if you have any other concern about its operation, please contact:

10.2 Data complaints and Board escalation

For complaints relating to how your personal data has been handled, please refer to the Privacy Notice. If you are not satisfied with Invest UP's response, you may escalate your complaint to the Data Protection Board of India in accordance with applicable law. Details of the complaint mechanism will be made available once notified by the Board.
